Community Care Advice

SWLLC is now offering a service for individuals needing assistance in the area of community care. Community care can cover many things but the main objective is providing care in the community which is facilitated by local authority social services departments. The underlying principle is to help individuals remain as independent as possible in light of any disabilities.  The service can also identify carers needs to make sure that these are also being met.

 

The service can cover the following:

 

·                     Obtaining an assessment of community care needs

·                     Issues involving residential/nursing care

·                     Obtaining an increase in the provision of community care services

·                     Challenging an assessment of identified needs

·                     Carers rights (including the right to a carer’s assessment)

·                     Entitlement to direct payments and budgets

·                     Charging for care services

·                     Funding disputes

·                     Obtaining adaptations to the home or the provision of equipment

·                     Obtaining care and support for children with disabilities

·                     Dealing with the difficult interface between community care and healthcare services

·                     Safeguarding vulnerable adults

·                     Closure of residential care homes or day centres

 

A case may be as simple as obtaining an assessment with a view to obtaining services or challenging decisions about the provision of services. More complex cases may involve the use of Judicial Review in the Administrative court if a local authority decision is considered to be unlawful and/or unreasonable. Complaints can also be raised, for instance if there is a failure to assess or the provision of services are of poor quality.
